Pro- and anti- slavery feelings ran high in California, and the founders of the cemetery strongly opposed the secessionist sentiment that threatened the nation's unity. Because of a controversy over the cemetery's ownership, the state enacted its first cemetery legislation, although its provisions did not affect Union Cemetery. The law of 1859 allowed for the incorporation of rural burial grounds. The state of California owned Union Cemetery from 1859 until 1962 when it was deeded to Redwood City. The post was chartered in 1879 with ten members and grew to several hundred. The remains of 36 of these veterans are buried here. In 1907 Col. James Thompson and James Needham obtained two cannons from the U.S. Government Armory at Benicia. The twenty-four pounder coastal guns were cast in 1844 at the West Point Foundry of New York and shipped to California during the Civil War. The cannons were placed here and dedicated on Memorial Day, May 30, 1907. In 1924 American Legion Post #74 replaced the original wooden cenotaph with the present day obelisk.  The cannons, obelisk, and grounds have been restored by the Stanislaus Civil War Association and with great pride are rededicated to honor and remember all veterans. Robert Lumpkin purchased the facilities in 1844, but the jail was built by Bacon Tait from 1830 on, and later leased to Lewis A. Collier, a fellow Richmond slave trader. Robert Lumpkin ran the jail until the liberation of Richmond by Union Troops on April 2nd, 18 1865. The Jail, also called the 'Devil's Half Acre' due to the horrible treatment of African Americans was used to punish 'runaway slaves', and tragically ripped apart countless families due to the sale of individuals. Countless enslaved Individuals were punished in this jail, the most well-known individual being Anthony Burns. Unfortunately, the majority of names of the individuals passing through this jail have been lost or destroyed.
