On May 22, 1861, upon his return to Grafton from a rally in Pruntytown, West Virginia, Private Brown was killed at the Fetterman Bridge by members of a Confederate militia that would later become a company of the 25th Virginia Infantry Regiment. Based on this account, Thornsbury Bailey Brown is widely considered to be the first Union soldier to be killed by a Confederate soldier during the American Civil War.
